Florida Attorney General James Uthmeier has opened a criminal investigation into OpenAI, seeking to determine whether ChatGPT played a role in aiding or abetting a gunman who killed two people at Florida State University. Prosecutors are reviewing chat logs between the AI chatbot and the shooter, Phoenix Ikner, as part of a broader effort to assess whether the company bears criminal responsibility for the interaction. The state has subpoenaed OpenAI for internal training materials and policies related to threat detection and crime reporting.
OpenAI has denied responsibility, stating that the platform provided factual information that was already publicly available and did not promote harmful activity. The case, however, raises questions that extend well beyond one company or one tragedy.
The legal frontier of AI liability
Criminal investigations into technology companies over user behavior are not without precedent, but they remain rare — and applying traditional criminal law concepts like "aiding and abetting" to a large language model represents largely uncharted territory. Aiding and abetting statutes typically require evidence that a party knowingly assisted or encouraged criminal conduct. Whether a chatbot, which generates responses based on statistical patterns rather than intent, can meet that legal threshold is a question no court has definitively resolved.
The distinction matters. A human accomplice can be shown to have understood the consequences of their assistance. A language model operates without awareness, purpose, or moral agency. Prosecutors in Florida will likely need to argue either that OpenAI's design choices and content policies were negligent enough to constitute facilitation, or that specific interactions between ChatGPT and the shooter crossed a line from passive information retrieval into something closer to active guidance. Both arguments face significant legal hurdles, but the investigation itself signals a willingness by state-level authorities to test those boundaries.
The subpoena for training materials and internal policies is notable. It suggests prosecutors are interested not only in what ChatGPT said to the shooter, but in what OpenAI knew — or should have known — about the risks its system posed. A finding of criminal liability — however unlikely legal scholars might consider it under current law — would fundamentally alter the risk landscape for every company deploying generative AI at scale. It would imply that the outputs of a language model can be treated, under certain circumstances, as the acts of the company that built it.
The technology industry has long operated under the shelter of Section 230 of the Communications Decency Act, which broadly shields platforms from liability for user-generated content. Whether that shield extends to AI-generated responses — content produced by the platform itself, not by a user — is an open and increasingly contested question.
OpenAI's defense, that the information ChatGPT provided was publicly available, echoes arguments made by search engines and social media platforms in earlier legal battles. But generative AI introduces a complication: unlike a search engine that returns links, a chatbot synthesizes and presents information in a conversational format that can feel personalized and directive. Whether courts will treat that difference as legally meaningful remains to be seen.
The Florida investigation sits at the intersection of several forces pulling in different directions: the rapid deployment of AI systems into everyday life, the slow adaptation of legal frameworks designed for a pre-AI world, and the political incentives that drive state attorneys general to act on public concern. How those forces resolve — whether through prosecution, legislation, or judicial precedent — will shape the operating environment for AI companies for years to come. The question is no longer whether governments will attempt to hold AI developers accountable for downstream harms, but on what terms.
