Attorney General James Uthmeier has initiated a criminal investigation into OpenAI after reviewing chat logs between its flagship AI, ChatGPT, and Phoenix Ikner, a 20-year-old student charged in a university shooting that killed two people and wounded six. The probe seeks to determine whether the "significant advice" the bot allegedly provided to Ikner constitutes criminal liability under the state's aiding and abetting statutes.

In a public statement, Uthmeier framed the investigation through a stark hypothetical: "if ChatGPT were a person," he argued, the nature of its interactions with the suspect would warrant murder charges. OpenAI has asserted that the bot is not responsible for the user's actions. The legal vacuum around generative AI

For decades, American technology law has rested on a relatively stable foundation. Yet the investigation appears to target not the model itself but OpenAI as the corporate entity responsible for deploying it. The Florida investigation forces a difficult reckoning with that gap. If chat logs show that ChatGPT provided tactical or logistical guidance relevant to the shooting, the question becomes whether OpenAI's safety infrastructure was adequate — and whether the company had reason to believe it was not.
